Terms of Service (AGB)

1. Scope

These Terms of Service (AGB) apply to all contracts between Emir Morozov (also known as Enes), operating under NextServ, and the customer regarding hosting services, including VPS and dedicated servers.

2. Conclusion of Contract

The contract is concluded once the customer accepts the hosting offer and the registration is successfully completed. The provider reserves the right to reject orders.

3. Service Description

Services include virtual private servers (VPS), dedicated servers, and related hosting services. Scope and availability are determined by the product description.

4. Customer Obligations

The customer must comply with applicable laws when using the services.

• Illegal activities such as distributing malware, spam, DDoS attacks, or copyright infringement are strictly prohibited.
• The customer is responsible for the security of login credentials and all activities conducted under their account.

5. Payment Terms

All prices are exclusive of applicable VAT. Payments must be made in advance for the selected term. The provider reserves the right to adjust prices with prior notice.

6. Termination and Contract Duration

The contract may be terminated by either party with 14 days' notice. Already paid amounts will cover the period until termination; beyond that, no claims exist.

7. Liability

The provider is only liable for damages caused intentionally or by gross negligence. No liability is assumed for indirect damages or lost profits, to the extent permitted by law.

8. Data Protection

9. Changes to Terms

The provider reserves the right to amend these terms. Changes will be communicated in advance; continued use constitutes acceptance.

10. Governing Law and Jurisdiction

German law applies. The place of jurisdiction for disputes is Berlin, if the customer is a merchant, legal entity under public law, or public fund.
